Does ADA Title II apply to PDFs?

As of Nov 8, 2026

Short version, from the DOJ’s own words: PDFs are covered web content, and one exception exists for some “preexisting” ones. This page quotes ADA.gov and does not say how it applies to your files. Not legal advice.

What the DOJ lists

Source: ADA.gov, web rule first steps. Among the exceptions it lists:

  • “Preexisting conventional electronic documents (PDFs, word processor file formats, presentation file formats, and spreadsheet file formats)”
  • “Exception for individualized, password-protected conventional electronic documents (PDFs, word processor file formats, presentation file formats, and spreadsheet file formats)”

Do old PDFs need to be remediated?

ADA.gov says:

“To qualify for this exception, your conventional electronic documents must be “preexisting,” meaning that they were posted before your public entity’s deadline for complying with the rule (see Action Step 2). The exception does not apply to new content posted after the compliance deadline.”

“This exception does not apply to documents that are currently used to access the public entity’s services, programs, or activities.”

The DOJ’s “Old PDFs” example

ADA.gov describes a town website with council minutes, past event announcements, scans of old records, applications for current programs, and ordinance lists. It says:

“Some of these PDFs probably need to comply with WCAG 2.1, while others may be covered by an exception.”

“The applications for current city programs and documents listing current city ordinances: Probably need to comply with WCAG 2.1 under the rule. It is unlikely that any of the exceptions to the rule would apply to those PDFs.”

Individualized, password-protected documents

ADA.gov’s hospital portal example says documents “about a specific person, property, or account” fall within that exception, while a PDF notice for multiple people “generally has to meet WCAG 2.1”.

Which compliance date applies to you

The “preexisting” cutoff depends on your entity’s compliance date. The interim final rule is at 91 FR 20902; use the date checker and deadline page.

Questions to ask your counsel

  • Which of our PDFs were posted before our compliance date?
  • Which are used to apply for or access a service, program, or activity?
  • What happens to a PDF we edit after the date?
